We own Velocity and our Services. You may not copy, reproduce, alter, modify, resell, mirror, or create derivative works of Velocity, our Services, or our content on Velocity without our written permission. You shall grant to us a royalty-free, worldwide, transferable, sub-licensable, irrevocable and perpetual license to incorporate into Velocity or otherwise use any suggestions, enhancement requests, recommendations or other feedback that we receive from you or your agents.

 

3. Disclaimer

By using Velocity services, you confirm that you have obtained all necessary permissions, including from LinkedIn, Github and Xing, for using Velocity with LinkedIn, Github and Xing services, including permissions for copy, use, disclose or distribute any information obtained from LinkedIn, Github and Xing. You agree that you will not use Velocity services if you do not have an explicit consent from LinkedIn, Github and Xing for using Velocity and/or similar products with LinkedIn, Github and Xing's service. Thus, Velocity holds no responsibility for inappropriate or illegitimate use of its services. You agree that you will only use Velocity with LinkedIn, Github and Xing profiles whose owners have granted you permissions to use, copy and store their LinkedIn, Github and Xing profile data.

 

This site, including any content or information contained within it or any site related service, or any product or service licensed, purchased or otherwise made available through the site, is provided "as is" with no representations or warranties of any kind, either expressed or implied to the fullest extent permissible pursuant to applicable law, Velocity and its subsidiaries, affiliates, suppliers, sponsors, and agents disclaim all warranties, express or implied, including, but not limited to, the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement neither its subsidiaries, affiliates, sponsors, suppliers nor agents makes any representation as to the results to be obtained from use of the site or the site-related services. 

 

Velocity and its subsidiaries, affiliates, suppliers, and agents will attempt to provide the best quality of service when possible, including concerns like availability, reliability and security, but do not warrant that your use of the site or the software will be completely uninterrupted, error-free, or secure. 

 

You acknowledge that you are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed to access and use the site, and all charges related thereto. You assume total responsibility and risk for your use of the site and the software and your reliance thereon. 

 

No opinion, advice, or statement of Velocity or its subsidiaries, affiliates, suppliers, agents, registered users, or visitors, whether made on the site, or otherwise, shall create any warranty. Your use of the site and any materials provided through the site are entirely at your own risk. You acknowledge that the Site could include inaccuracies or errors. In case of insufficient amount of data or information in your Vincere account, Velocity will not be able to guarantee the accuracy of the services provided. 

 

In the event that such a situation arises, please contact us at team@Velocity.com with, if possible, a description of the material to be checked and the location (URL) where such material can be found on the Site, as well as information sufficient to enable us to contact you. 

 

Neither Velocity nor its subsidiaries, creators, owners, contractors, affiliates, suppliers, advertisers, agents or sponsors are responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to the site and/or content contained on the site, or any product or service purchased through the site. Your sole remedy for dissatisfaction with the site and/or content contained within the site is to stop using the site. We are not responsible for any inappropriate use of the Velocity Services which may result in damage, cause harm or violate any terms of use of any parties involved.

 

4. Service Functionality

You agree that service will be accessing and processing the data from your Vincere account. Processing data includes:

 

- Fetching data from the system

- Filtering and aggregation of data

- Inserting and updating records into the system

 

You also agree that the service will store the error and activity logs of your interactions with the service for debugging. Activity logs are stored as long as you are using the service, and are removed within one month after you unsubscribe from the service.

 

5. Cancellation and Termination

 

You are solely responsible for the proper cancellation of your account. You may cancel your account at any time by removing your use of Velocity. An email or phone request to cancel your account is not considered cancellation. There is no cancellation fee. We retain the right to retain or delete data provided to us by you at our sole discretion. We also reserve the right, but do not have any obligation, to refuse service to anyone and close your account(s) without notice for any or no reason at all.

 

6. Passwords and Accounts

 

You will be required to use your credentials which is associated with your account in Vincere. You will be responsible for the confidentiality and use of your password and agree not to distribute, transfer or resell your use of or access to the Site to any third party. You agree to notify us immediately of any unauthorized use of your account(s). We’re not responsible for any losses due to stolen or hacked passwords.

 

7. Indemnification

You agree to indemnify and hold us harmless from any and all demands, loss, liability, claims or expenses (including attorneys’ fees) made against us by any third party due to or arising out of or in connection with your use of Velocity.

 

8. Force Majeure

You agree that we are not liable for any delays or failure in performance of any part of the Services, from any cause beyond our control.

 

9. Entire Agreement

These Terms and all documents incorporated into these Terms by reference constitute the entire agreement between you and us and govern your use of Velocity, superseding any prior agreements between you and us (including, but not limited to, any prior versions of the Terms of Service).

 

10. Amendments and Changes to Velocity

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of the Terms, at any time. Amendments or changes to these Terms won’t be effective until we post revised Terms on the Website. Your continued use of Velocity following the posting of changes will mean that you accept and agree to the changes.
